Plan License Agreement

Please read this agreement carefully before purchasing. By purchasing a house plan from Modern Homes ATX, LLC, you agree to be bound by these terms.

1. Parties

This Plan License Agreement ("Agreement") is between you ("Licensee," "Buyer," or "you") and Modern Homes ATX, LLC ("Licensor," "we," "us"), the seller and licensing party for house plans designed by Simon Chen, RA (Texas Registered Architect License #27129) and offered for license through this website.

2. What You Are Purchasing

When you purchase a plan set from this site, you are purchasing a limited, non-transferable license to use the plan design for the construction of a single home, not the copyright or ownership of the design itself. The original architect/designer retains full copyright ownership of the plan and all derivative works.

3. Scope of License

Unless you purchase a specifically labeled "multi-use" or "unlimited-build" license:

You may build one (1) home from a purchased plan.
You may not use the plan, in whole or in part, to build additional homes without purchasing an additional license.
You may not resell, sublicense, redistribute, publish, or share the plan files (PDF, CAD, or printed sets) with any party other than your contractor, subcontractors, engineer, or local building department, solely for the purpose of constructing your single licensed home.
You may not modify the plan and then resell or relicense the modified design as your own.
Printed sets marked "Study Set" or "Not for Construction" may not be used to obtain permits or begin construction.

4. Modifications

If you purchase a CAD file, you (or your design professional) may make modifications for your own use under this license. Modified plans remain subject to the underlying copyright — you may not resell or relicense a modified version to third parties.
If we perform modifications on your behalf as a paid service, those modifications are covered by a separate modification agreement and do not expand your license beyond a single build unless otherwise stated in writing.
Neither Modern Homes ATX, LLC nor the original designer is responsible for the accuracy, code compliance, or structural integrity of any modifications made by you or a third party after delivery of the original plan.

5. No Guarantee of Permit-Readiness or Code Compliance

Plans are designed to general/reference building code standards at the time of original design. Building codes, zoning ordinances, and permitting requirements vary by state, county, and city, and change over time. You are solely responsible for:

Verifying that the plan complies with all codes, ordinances, and requirements applicable to your specific site and jurisdiction
Obtaining any additional stamped/sealed documents, site-specific engineering, or local modifications required for permitting in your area
Confirming requirements with your local building department before beginning construction

Modern Homes ATX, LLC and the original designer make no guarantee that any plan, as purchased, will be accepted for permit in your jurisdiction without modification.

6. No Architect-Client or Engineer-Client Relationship

Purchasing a stock plan from this website does not create an architect-client relationship, an engineer-client relationship, or any professional services engagement between you and Simon Chen, RA, Modern Homes ATX, LLC, or any affiliated entity. Your purchase does not include:

Construction administration or site visits
Site-specific code review
Professional stamping or sealing for your jurisdiction (unless separately purchased as an add-on service)
Ongoing design consultation

If you require these services, please contact us separately to discuss a professional services engagement, which will be governed by its own written agreement.

7. Materials Lists and Cost-to-Build Estimates

Any materials list or cost-to-build estimate provided with your plan is an estimate only, based on general/average data. Actual costs and material quantities will vary based on your location, material selections, labor rates, and site conditions. These estimates should not be relied upon for budgeting or bidding purposes without independent verification by your contractor or supplier.

8. Limitation of Liability

To the fullest extent permitted by law, our total liability arising from this Agreement or your use of a licensed plan is limited to the amount you paid for the plan. We are not liable for construction costs, delays, code compliance failures, or any damages arising from modifications made by you or third parties after delivery.

9. Termination

Your license terminates automatically if you violate any term of this Agreement, including unauthorized resale or redistribution. Upon termination, you must cease all use of the plan and destroy all copies in your possession.
