Professional Services & Dual-License Disclosure

This page explains the relationship between Modern Homes ATX, LLC, Simon Chen's architectural practice, and Simon Chen's real estate license, so there is no confusion about which capacity applies to which part of your purchase or interaction with this site.

Entity Structure

Modern Homes ATX, LLC owns and operates this website and is the seller of record for house plans purchased here.
House plans offered on this site are designed by Simon Chen, a Texas Registered Architect (License #27129). Simon Chen's architectural practice operates separately as Simon Structures LLC, DBA Swan Studio Architects.
Simon Chen also holds a Texas Real Estate License and may, in some cases, be involved in identifying or listing land/lots referenced or featured on this site.

When You Are Purchasing a Plan

When you purchase a house plan through this website, you are purchasing from Modern Homes ATX, LLC under the terms of our Plan License Agreement. This transaction does not involve Simon Chen acting in his capacity as a licensed real estate agent, and does not create a real estate brokerage relationship.

When Real Estate Services Are Involved

If Simon Chen assists you, in his capacity as a licensed Texas real estate agent, with identifying, evaluating, or purchasing a specific lot or parcel of land — whether referenced on this site or discussed separately — that assistance is governed by applicable Texas Real Estate Commission (TREC) rules and disclosure requirements, separately from your plan purchase. You will be provided the required TREC disclosures (including the Information About Brokerage Services notice) at the time real estate services begin, if applicable.

No Combined Professional Relationship

Purchasing a house plan does not:

Establish Simon Chen as your real estate agent or broker
Establish an architect-client relationship for services beyond the licensed stock plan itself (see our Plan License Agreement, Section 6)
Obligate Simon Chen, Modern Homes ATX, LLC, or Simon Structures LLC/Swan Studio Architects to provide real estate representation, site selection, or brokerage services

Each professional service — architectural plan licensing and real estate representation — is engaged separately, in writing, and disclosed to you in the applicable capacity at the time that service begins.

Customization Requests

If you request modifications or lot-specific customization of a plan purchased on this site, that work is performed by Swan Studio Architects (Simon Structures LLC, DBA Swan Studio Architects), under a separate written agreement and separate invoice from your Modern Homes ATX plan purchase. Submitting a customization request does not itself create an architect-client relationship — that relationship begins only once you and Swan Studio Architects have signed a scope of work. Modern Homes ATX, LLC does not perform architectural services and does not invoice for customization work; all such work is contracted, insured, and delivered by Swan Studio Architects.

Insurance

Simon Structures LLC, DBA Swan Studio Architects, maintains professional liability (errors & omissions) and general liability insurance applicable to custom architectural design services performed under that entity. Modern Homes ATX, LLC maintains separate business insurance applicable to its plan licensing and ecommerce operations.
